The US International Trade Commission (US ITC) has issued a Final Initial Determination (ID) on Samsung’s case against BOE, accusing the Chinese company of patent infringement. The ID recommends a limited exclusion order and a cease-and-desist order, which would prevent the import of BOE’s OLED panels and smartphones made with those panels.

Samsung’s initial complaint to the US ITC was submitted in October 2023, and the US ITC’s Administrative Law Judge (ALJ) assigned to the case set an initial target date for the ID as May 29, 2025, which was subsequently extended for six weeks to July 11, 2025. The complaint named eight different BOE entities as respondents. In its ID, the ALJ states that Samsung Display “has proven by a preponderance of evidence” that:

  • BOE violated US law (the Tariff Act of 1930) by importing OLED display modules and components by reason of misappropriation of trade secrets.
  • SDC owns at least one protectable trade secret among its asserted trade secrets.
  • BOE has imported OLED display panels, OLED display modules, and components of OLED displays.
  • BOE imported products made according to at least one of SDC’s trade secrets.
  • BOE misappropriated at least one of SDC’s trade secrets.
  • BOE’s importation of OLED panels has injured SDC’s US domestic industry.

The ID also states that BOE failed to prove by a preponderance of evidence that the misappropriated trade secrets were independently developed or derived from public sources.

The ID concludes with a recommendation for a limited exclusion order (LEO), which would prevent the import of BOE’s OLED panels, and a cease-and-desist order against each of the eight BOE companies.

Subsequent to the ID, the US ITC issued a notice of request for submissions on the public interest in this case. The notice asks members of the public and government agencies to address whether the LEO would affect the public health and welfare in the US. Written submissions must be filed by August 12, 2025.
